In the EULA of MapPoint 2004 they talk about a delay which decides if the solution is a Fleet application or not. I asked Microsoft, this is the answer:

“To the question of delay for fleet tracking. This is not a definition decided by Microsoft, but by our data vendor (Navteq) . Normally the real time, or near real time, is interpreted as less than 2 minutes delay.

However, please note that this delay exception is removed in MapPoint 2006. You will need a Fleet Edition regardless of the delay in the 2006 edition. Also, please note that the standard version of 2004 limits the number of vehicles you can track to 50 per license, regardless of the delay or not.”

Confusing situation: in the forum they talk about 15 seconds of delay

I think that Microsoft doesnt care how MP2004 is used. Microsoft even promotes these types of fleet applications on their MapPoint web site. Look at the list of solution providers.

I think you're right about Microsoft not caring so much, but even so they'd rather solution providers and partners, especially major ones, be legal with their usage so it does not come back at them.
